DWI Arrest Of Morristown Councilwoman Captured On Body Cam Video
"I can smell booze in the car," one officer can be heard saying in the body cam footage.

MORRIS COUNTY, NJ — Released Denville Police body camera video captures the arrest of Toshiba Foster, a Morristown councilwoman who was driving drunk behind the wheel, police said.
On Sept. 6, around 10:30 p.m., a Denville police officer ran a random license plate check on a Foster’s car, which was traveling on Route 53.
The license plate check found that the car was unregistered, and the officer pulled Foster over on Route 53, police said.

Footage shows officers after pulling Foster’s car, and a police officer can almost immediately be heard saying, “I can smell booze in the car, she’s a little bloodshot.”

The footage also shows officers instructing Foster, several times, to perform common DWI tests, including Horizontal Gaze Nystagmus (follow the finger), the walk-and-turn, and the one-leg stand.
After failing the tests, Foster is cuffed and placed in the police car.
The video also captures police recovering several bottles of prosecco from Foster’s car.

According to the YouTube account that posted the video, Transparency Bodycam, Toshiba was taken back to the station and admitted a breathalyzer test and blew a .20 BAC level, more than twice the legal limit.
She was processed by the Denville police, charged with driving while intoxicated, reckless driving, careless driving, and driving an unregistered vehicle.
A report from The Morris NewsBee said that Foster is represented by Morristown attorney Terry Webb. Webb told the NewsBee that Foster has pleaded not guilty to her charges.
“Toshiba Foster was issued motor vehicle tickets. Pursuant to her constitutional right to be presumed innocent she has pled not guilty. We are confident that the traffic matter will be justly resolved,” Webb told the NewsBee.
Patch has reached out to Foster for comment, but has not heard back at this time.
The Democrat is currently seeking reelection to the council come November.
