Sexual Assault, Other Charges Against Concord Teen Nolle Prossed Due To Lack Of Victim Cooperation

Follow-up: Some of the 10 January 2025 counts against Zaymen Burdette can be refiled for up to 22 years after the victim's 18th birthday.

CONCORD, NH — A teen from Concord who received a suspended sentence for a sexual assault case in 2024 has avoided a second round of charges, at least for now, due to a lack of victim cooperation, according to court documents.

Ten charges against Zaymen Burdette, 19, of Concord, including felony computer services and felonious sexual assault charges, were nolle prossed on Jan. 28, mere days before jury selection was to begin in the case, with a trial booked for mid-March. A court filing stated the reason for the dropped charges was “victim not cooperating.”

The Merrimack County Attorney’s Office did not offer comment on the case.

The case against Burdette came to fruition after he was charged in January 2025 with sale of a controlled drug-marijuana or hashish, computer services-use prohibited, contributing to the delinquency of a minor, and three sexual assault-penetration-13- to 15-years of age with an age difference of less than three years after an incident or investigation on Parmenter Road. That case started after the Concord Regional Crimeline received a tip in October 2024 about the possibility that a girl was sexually assaulted, according to police. The tip also contained information about a suspect distributing controlled substances in the city, according to police.

In March 2025, Burdette reached a plea deal in the January 2025 case, pleading guilty to two simple assault charges and was sentenced to two 12-month sentences, both suspended for two years, with two years of good behavior probation and two days of time-served credit. Five other charges, including the sexual assault counts, were nolle prossed.

In the second case, Burdette was accused of using Snapchat to lure a girl under 16 for felonious sexual assault. Detectives held multiple interviews, executed search warrants, and collected physical and digital forensic evidence, and, in doing so, learned Burdette was out on bail on the first set of charges.

Between July 2025 and January, several motions and requests for sealing decisions were made in the latter case. Burdette was indicted on all 10 counts in September 2025. In October 2025, he was arraigned on the charges. The victim then decided not to cooperate and the charges were dropped.

While nolle prossed, Burdette could face the charges again if they are refiled. Child sexual assault victims have until they are 40, 22 years after their 18th birthday, to bring forward charges.
