"No means no. That is the beginning and end of the conversation," DA Cacace said, announcing a multi-count felony indictment.
"Sexual activity without consent is a crime, one that is vigorously prosecuted by my office," DA Cacace said.
The child was found on a sidewalk without a shirt or shoes on when New Rochelle police arrived, and was later declared dead.
The drugs seized had a street value of approximately $1 million, according to the Westchester County District Attorney's Office.
The landmark trial was the very first under the Penal Law's "torture-murder" provision in Westchester County history, DA Cacace said.
The 46-year-old is charged with aggravated harassment. He is now ordered to stay away from the superintendent and all district properties.

A 911 caller reported hearing the sound of glass breaking and then seeing an unknown man entering the New Rochelle home through a window.
The victim told New Rochelle police that an unknown man approached him, and without provocation, slashed him across the face.
